BuddyClients Plugin Terms of Service

These Terms of Service (“Terms”) govern your use of the BuddyClients plugin (the “Plugin”), a WordPress plugin developed by Victoria Griffin (victoriagrif7) (“we,” “us,” or “our”). By downloading, installing, or using the Plugin, you agree to these Terms. If you do not agree with these Terms, do not use the Plugin.

The BuddyClients Plugin refers to the premium WordPress plugin distributed through BuddyClients.com. Users of the BuddyClients Free Plugin available through the WordPress Plugin Repository should refer to the BuddyClients Free Plugin Terms of Service.

1. License Grant

If you purchase the paid version of the Plugin, you are granted a non-exclusive, non-transferable license to use the Plugin on the number of sites specified in your purchase. This license allows you to install and use the Plugin only for your personal or business use. You may not resell, redistribute, or sublicense the Plugin.

BuddyClients is released under the GPL-2.0-or-later license for the core functionality. This allows you to modify, redistribute, and use the plugin in accordance with the GPL.

Certain premium features, such as advanced reporting and support, are available under the BuddyClients commercial license. If you choose to use the premium features, you must purchase a commercial license, which comes with additional terms, including:

  • Non-disclosure of source code.
  • Use in closed-source projects.
  • Priority support.

By purchasing a commercial license, you gain access to additional features and support as outlined in the paid version.

2. Plugin Updates

The Plugin will receive regular updates, including bug fixes, security patches, and feature enhancements. Updates are provided at our discretion and are subject to the availability of the features in the version of the Plugin you have purchased or are using.

Updates will be automatically available to you via your WordPress dashboard. Users can also access the most up to date Plugin version through their account and may download and install the plugin manually. Users are encouraged to keep their plugin up to date to ensure compatibility and security.

3. Payment and Subscription

Payment: If you opt for the paid version of the Plugin, payment is processed through Stripe or another payment gateway as indicated during checkout. Payment details, including but not limited to credit card information, are securely handled and processed by Stripe and are subject to their Privacy Policy.

Subscription: The paid version may require a subscription, either one-time or recurring. You agree to pay all applicable fees for the subscription, and you authorize us to charge your payment method for any applicable fees.

Cancellation: You can cancel your subscription at any time by managing your account settings or by contacting us. Upon cancellation, you will lose access to premium features at the end of your current billing period.

4. Stripe Integration (Optional)

If you enable the Stripe integration, the Plugin will transmit customer information, including name and email address, to Stripe for payment processing. This data is transmitted securely using encryption protocols. You may disable this integration via the Plugin settings at any time.

By using the payment features provided by Stripe, you agree to comply with Stripe’s Terms of Service and acknowledge their Privacy Policy.

5. User Responsibilities

Usage: You agree to use the Plugin only for lawful purposes and in accordance with these Terms. You are solely responsible for any content or data you upload, share, or process using the Plugin

Prohibited Use: You may not use the Plugin for any illegal activity, to violate the rights of others, or in any way that could damage, disable, or impair the Plugin or its functionality.

6. External Services

The Plugin may connect to third-party services for features such as license validation and payment processing (e.g., Stripe). These external services are governed by their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

The Plugin collects certain data such as License Key, Site URL, and Plugin Download Statistics to validate licenses and improve the Plugin. This data is collected anonymously and does not include personally identifiable information unless you provide it for payment processing via Stripe.

9. Termination

We reserve the right to suspend or terminate your access to the Plugin if you violate these Terms. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the Plugin.

10. Limitation of Liability

The Plugin is provided “as-is,” and we do not guarantee its functionality or suitability for any particular purpose. To the extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Plugin, including but not limited to data loss or interruption of business.

11. Limitation of Liability for Legal Features

The Plugin includes tools to assist with the creation and management of legal agreements. However, these tools are provided “as-is” and are intended solely as a general guide. We do not provide legal advice. The creation, review, and implementation of any legal agreements should be done in consultation with a qualified attorney.

By using the legal tools within the Plugin, you acknowledge and agree that:

You agree to indemnify and hold harmless BuddyClients, its developer, and its affiliates, officers, and employees from any legal claims, losses, damages, or costs (including reasonable attorney’s fees) that result from your use of the legal features within the Plugin.

You agree to indemnify and hold harmless BuddyClients, its developer, and its affiliates, officers, and employees from any claim, demand, loss, or damages, including reasonable attorney’s fees, arising from your use of the Plugin or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. Any changes will be communicated through the Plugin’s changelog or our website. Continued use of the Plugin after such changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Union County, Tennessee, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be resolved in the competent courts of Union County, Tennessee.
